Section 9
<br> who can implement the project through negotiations
Notwithstanding anything else written in this Act, the Government of Nepal may implement any project through negotiation in the following cases:-
(a) In spite of calling for letters of intent or proposals at least twice in accordance with this Act, the required number of letters of intent or proposals have not been selected, or (b) is unlikely to be contested, or
(c) involving a new concept or technology, or
(d) having an estimated cost of more than two billion rupees, or
(e) recommended by the Committee to be carried out by negotiation, or
(f) For any reason, it is not considered appropriate to adopt other procedures according to this Act.
(2) A person who wants to implement a project under sub-section (1) through negotiation shall submit an application to the Government of Nepal by disclosing the specified information.
(3) After examining the application received under sub-section (2), if it is found suitable to implement the project through negotiation, the Government of Nepal will negotiate with the applicant and implement it.
(4) When implementing the project through negotiation in accordance with this section, the Government of Nepal will request the details from the applicant as per sub-section (2) of section 6.
